Elite Skills & Fitness – Terms & Conditions

1. Introduction

These Terms & Conditions govern all bookings, attendance, participation and use of services delivered by Elite Skills & Fitness ("the Provider"). By booking a session, club, camp, course, or activity, parents/carers and participants agree to comply with these Terms.

These Terms are designed to protect the safety and wellbeing of children, families, staff and the Provider, and to ensure services operate in line with safeguarding and Ofsted expectations where applicable.

2. Definitions

  • Provider – Elite Skills & Fitness

  • Parent/Carer – Individual booking and responsible for the child

  • Child – Participant under 18 years

  • Session – Any coaching, club, camp, or activity delivered

  • Venue – Location where activities take place

3. Booking & Registration

  • All bookings must be completed via the official online system at eliteskillsandfitness.com unless otherwise agreed

  • A place is only secured once full payment or confirmed childcare funding has been received

  • Parents/carers must provide accurate and complete information including:

    • Emergency contact details

    • Medical conditions and allergies

    • Collection permissions

    • Additional needs or behavioural considerations

  • The Provider reserves the right to refuse or cancel a booking where information is incomplete, inaccurate, or where needs cannot be safely met

4. Payments

  • Payment is required at the time of booking unless a payment plan or funding route is agreed

  • Accepted payment methods may include:

    • Online card payment

    • Bank transfer

    • Tax-Free Childcare

    • Childcare vouchers (at eligible Ofsted-registered venues)

  • Failure to complete payment may result in cancellation of the booking

  • Outstanding balances may result in a child being unable to attend sessions

5. Subscriptions & Block Bookings

  • Subscription and block bookings secure a place for the specified duration only

  • Payments remain due even if a child does not attend

  • The Provider reserves the right to adjust session times, venues or coaches where required for operational reasons

 

6. Cancellations & Refunds

Parent/Carer Cancellations

  • Bookings are non-refundable except in exceptional circumstances at the Provider’s discretion

  • No refunds will be issued for:

    • Non-attendance

    • Change of mind

    • Schedule conflicts

Provider Cancellations

If a session must be cancelled due to circumstances beyond control (including but not limited to weather, venue closure, staff illness, safety risks or emergencies), the Provider may:

  • Offer a credit

  • Offer an alternative session

  • Reschedule where possible

Refunds are not guaranteed.

7. Attendance & Absence

  • Parents/carers are responsible for ensuring children attend booked sessions on time

  • Missed sessions are not refundable or transferable

  • Persistent absence may result in a place being withdrawn where demand is high

8. Safeguarding & Child Welfare

The Provider operates with safeguarding as a priority.

  • All staff and volunteers follow safeguarding procedures

  • Concerns relating to a child’s welfare may be shared with appropriate safeguarding authorities

  • The Provider reserves the right to refuse attendance if a child’s safety, or the safety of others, cannot be assured

 

9. Behaviour Expectations

Children must:

  • Follow staff instructions

  • Treat others with respect

  • Use equipment safely

The Provider reserves the right to:

  • Issue behaviour warnings

  • Contact parents/carers

  • Remove a child from a session

  • Withdraw a place without refund where behaviour poses risk

10. Health, Medical & Illness

  • Parents must disclose all relevant medical conditions

  • Children who are unwell must not attend

  • Any child who becomes unwell during a session may be sent home

  • Immediate collection will be required for vomiting, suspected infection, or contagious illness

The Provider may administer basic first aid and seek emergency medical assistance if required.

11. Collection of Children

  • Children must be collected promptly at the end of sessions

  • Late collection may incur a charge

  • Only authorised adults listed at registration may collect

  • Identification may be requested

Where a child is not collected and contact cannot be made, safeguarding procedures will be followed.

12. Use of Phones & Devices

  • Children are not permitted to use mobile phones during sessions

  • Staff phones may only be used for safeguarding, communication, or operational purposes

  • Personal devices may only be used for music delivery where appropriate

13. Photography & Media

  • Photographs or videos may be taken for coaching review, safeguarding, or promotional use

  • Consent will be obtained during registration

  • Parents may withdraw consent in writing

​

14. Data Protection

The Provider handles personal information in line with data protection legislation.

Information is used to:

  • Deliver services

  • Maintain safeguarding records

  • Communicate with families

  • Meet legal and regulatory duties

Data is stored securely and only shared where necessary.

15. Liability

  • Activities involve physical participation and carry inherent risk

  • The Provider takes reasonable steps to ensure safety but cannot eliminate all risk

  • Parents accept responsibility for ensuring children are fit to participate

The Provider shall not be liable for:

  • Loss of personal belongings

  • Injuries resulting from undisclosed medical conditions

  • Incidents arising from failure to follow instructions

Nothing in these Terms excludes liability where it would be unlawful to do so.

16. Insurance

The Provider maintains appropriate public liability insurance and employer’s liability insurance where required.

17. Weather & Force Majeure

Sessions may be altered, postponed, or cancelled due to circumstances outside the Provider’s control, including:

  • Extreme weather

  • Venue closure

  • Safety risks

  • Public health incidents

  • Government guidance

Credits or alternative sessions may be offered at the Provider’s discretion.

18. Complaints

Complaints should be submitted in writing. The Provider will:

  • Acknowledge concerns

  • Investigate appropriately

  • Respond within a reasonable timeframe

​

19. Changes to Services

The Provider reserves the right to:

  • Change coaches

  • Adjust session content

  • Move venues

  • Amend schedules

Where possible, reasonable notice will be provided.

20. Termination of Place

The Provider may terminate a child’s place without refund where:

  • Behaviour risks safety

  • Terms are breached

  • Payment is not made

  • Information provided is false or misleading

​

21. Agreement

By booking or attending a session, parents/carers confirm they:

  • Accept these Terms & Conditions

  • Provide accurate information

  • Agree to safeguarding expectations

  • Accept operational procedures

​

22. Review

These Terms & Conditions are reviewed regularly to ensure they remain current, safe, and aligned with operational and regulatory expectations.
